Barrett was an economics and law scholar in George Washington University before returning to her old school, Notre Dame, in 2002 to teach federal courts, constitutional law and the interpretation of statutes. When she was at Notre Dame she was appointed an Associate Professor in the year 2010 and from 2014 to 2017 she held the Diane and M.O. Miller Research Chair of Law. Barrett continues to teach in the capacity of a judge.

After graduating from law school, Barrett worked as an assistant for the Judge Laurence Silberman of the United States Court of Appeals for the District of Columbia Circuit. Then, she worked as a clerk for the Associate Justice Antonin Scalia of the Supreme Court of the United States between 1998 and 1999. From 1999 to 2002 she worked in the firm of Miller, Cassidy, Larroca & Lewin in Washington, D.C..

On October 30, 2017, the Senate invoked cloture by a vote of 54–42.
